Please read these terms carefully before placing an order. They tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information.

In these terms, "we", "us" and "our" mean MarketMate Solutions Ltd, and "you" and "your" mean the person placing the order.

2. These terms

These terms apply to your use of our website and to every order you place with us. By placing an order you accept them, so please read them before you buy. We recommend you save or print a copy for your records.

We may amend these terms from time to time. The version that applies to your order is the version published on the website at the time you placed it.

3. Using our website

You may use our website for lawful purposes only. You must not misuse it by knowingly introducing malicious code, attempting to gain unauthorised access to it, or using automated systems to scrape content or place orders.

All content on this website, including text, product descriptions, photographs, graphics and layout, is owned by us or licensed to us and is protected by copyright and other intellectual property rights. You may view and print pages for your own personal use. You may not copy, republish or use our content commercially without our written permission.

If you create an account, you are responsible for keeping your password confidential and for activity that takes place under your account. Tell us straight away if you think someone else has used it.

4. Our products

We take care to describe and photograph our products accurately. Colours on screen can vary between devices and monitors, so the shade you see may differ slightly from the product itself.

Sizing information is provided as a guide. Where a measurement is given, please measure your child rather than relying on age alone, since children of the same age vary considerably.

Products are subject to availability. Packaging, product design and specification may change from time to time where the supplier makes changes, provided the change does not materially affect the quality or performance of the product.

Waterproof ratings quoted on our product pages are the figures supplied to us by the manufacturer and describe the fabric as tested. They are not a guarantee that a garment will remain dry in every circumstance, particularly if it is damaged, worn incorrectly or not cared for as instructed.

5. Placing an order

Our website will guide you through the ordering process, and you will have an opportunity to check and correct your order before you submit it.

When you place an order, you are making an offer to buy. We will send an acknowledgement email confirming that we have received it. That acknowledgement is not acceptance of your order.

A contract between us comes into existence when we send you an email confirming that your order has been dispatched. If we cannot accept your order, for example because the item is out of stock, because we have identified a pricing or description error, because we cannot deliver to your address, or because we suspect fraud, we will tell you and will not charge you, or will refund any payment already taken.

Orders may only be placed by people aged 18 or over.

6. Prices and taxes

Prices include UK VAT where applicable. If your delivery address is outside the United Kingdom, VAT treatment depends on the destination and will be shown at checkout. Delivery charges are shown separately before you complete your order.

We take reasonable care to ensure prices are correct. If we discover an error in the price of a product you have ordered, we will contact you before dispatch and give you the choice of continuing at the correct price or cancelling for a full refund. If the pricing error is obvious and you could reasonably have recognised it as an error, we do not have to supply the product at the incorrect price.

We may change prices at any time, but changes will not affect orders we have already accepted.

7. Payment

We accept the payment methods shown at checkout. Payment is taken at the point of order through our payment provider. We do not see or store your full card details.

Ownership of the products passes to you when we receive payment in full.

8. Delivery

We deliver to the destinations listed at checkout. Delivery options, costs and estimated timescales are set out on our delivery page and shown before you complete your order.

Estimated delivery times are estimates and are not guaranteed. If something outside our control delays your order, we will let you know and do what we reasonably can to reduce the delay.

Under UK consumer law, if we have not agreed a specific delivery date with you, we will deliver within 30 days of the day the contract is made. If we miss that deadline and delivery by a particular date was essential, or you told us before we accepted your order that delivery by a particular date was essential, you may treat the contract as at an end and receive a refund for the undelivered items.

The products become your responsibility from the time they are delivered to the address you gave us, or to a neighbour, safe place or collection point in line with the delivery instructions you or the carrier applied.

If nobody is available to take delivery and the products cannot be posted through the letterbox or left safely, the carrier will leave a note. If the parcel is returned to us undelivered after failed attempts, we will contact you to arrange redelivery, which may be chargeable.

9. International orders, duties and import taxes

If you are ordering to an address outside the United Kingdom, your order may be subject to import duties, taxes and customs clearance charges applied by the destination country. Unless our checkout clearly states that duties and taxes have been collected from you in advance, these charges are your responsibility and are payable in addition to the price you paid us. We have no control over them and cannot predict their amount.

You are treated as the importer of the goods and are responsible for complying with the laws and regulations of the country you are importing into. Please check whether there are any restrictions before you order.

If a parcel is refused or abandoned at customs and returned to us, we will refund the price of the goods less any costs we incur, including outbound and return carriage and any charges levied by the carrier or customs authority.

10. Your right to cancel

If you are a consumer in the UK or the EU, you have a legal right to cancel your order within 14 days of the day you, or someone you nominate, receives the goods. Where an order is delivered in instalments, that period runs from the day you receive the last item.

To cancel, tell us clearly before the 14 days are up, by emailing info@wetweatherkids.com with your name, address and order number. You may use the model cancellation form set out at the end of these terms, but you do not have to.

Once you have told us you are cancelling, return the goods to us within 14 days. Unless the goods are faulty or not as described, you are responsible for the cost of returning them, and for looking after them while they are in your possession. You may handle the goods as you would in a shop, but if you reduce their value by handling them more than that, we may deduct an amount to reflect the reduction.

We will refund the price you paid, together with the standard outbound delivery cost, within 14 days of receiving the goods back or of you providing proof that you have sent them, whichever is earlier. If you chose a more expensive delivery option, we refund the cost of our standard option only. Refunds are made to the payment method you used.

Our returns policy. In addition to your legal rights, we accept returns of unused, unworn products in their original condition and packaging within seven days of delivery. Full details, including where to send your return, are on our returns page.

If you are a consumer outside the UK and the EU, the statutory cancellation right above does not apply to you, but our returns policy does.

11. If there is a problem with your order

Please tell us as soon as possible by emailing info@wetweatherkids.com with your order number and, where relevant, photographs of the problem.

If you are a consumer in the UK, the Consumer Rights Act 2015 gives you rights that these terms do not affect. In summary, goods must be as described, fit for purpose and of satisfactory quality. If they are not:

Within 30 days of receiving them, you can reject them and get a full refund
After 30 days and up to six months, you can ask us to repair or replace them, and if that is not successful, you can claim a refund, which may be reduced to reflect the use you have had
After six months, you retain rights for up to six years from delivery in England, Wales and Northern Ireland, or five years from discovering the problem in Scotland, but you may need to show that the fault was present when the goods were delivered

We will pay the cost of return postage for faulty or misdescribed items.

These rights do not cover fair wear and tear, damage caused by accident or misuse, or damage caused by failing to follow the care instructions, including washing at high temperatures, using fabric softener or tumble drying waterproof garments.

Consumers in the EU and in other countries have their own statutory rights, which these terms do not limit.

12. Product use and safety

Our products are outdoor clothing for children and adults. They are not personal protective equipment, safety equipment or high visibility clothing to any published standard, and reflective detailing is intended to improve visibility, not to guarantee it. Children should be supervised outdoors, particularly near roads and water.

Please follow the care instructions supplied with the product to maintain waterproof performance.

13. Our liability to you

We do not exclude or limit our liability in any way where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the products, and for defective products under the Consumer Protection Act 1987.

Subject to that, if we fail to comply with these terms we are responsible for loss or damage you suffer that is a foreseeable result of our breaking the contract or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

We supply the products for domestic and private use. If you use them for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

14. Events outside our control

We are not liable for delays or failures caused by events outside our reasonable control, including extreme weather, fire, flood, industrial action, carrier failure, supply chain disruption, pandemic restrictions, failure of public networks or the acts of government. If such an event occurs, we will contact you as soon as possible and take reasonable steps to reduce its effect. If the delay is substantial, you may cancel and receive a refund for anything paid for but not received.

15. Ending the contract

You may end the contract at any time before dispatch by contacting us, and we will refund you in full.

We may end the contract if you do not make a payment when it is due, or if you do not provide information we need within a reasonable time to fulfil your order.

16. Complaints

If you are unhappy with a product or with our service, email info@wetweatherkids.com and we will look into it. We aim to acknowledge complaints within two working days and to resolve them within 14 days. If we cannot resolve a complaint between us, you may be able to refer it to an alternative dispute resolution provider, and nothing in these terms prevents you from taking court proceedings.

17. Your personal information

We use your personal information as set out in our Privacy Policy, which forms part of these terms.

18. Other important terms

We may transfer our rights and obligations under these terms to another organisation, and we will tell you in writing if that happens. Your rights under the contract will not be affected.

You may only transfer your rights or obligations under these terms to another person if we agree in writing.

The contract is between you and us. No other person has any rights to enforce any of its terms.

Each paragraph of these terms operates separately. If a court decides that any of them is unlawful, the remaining paragraphs will remain in force.

If we delay in enforcing the contract, or do not insist that you do something you are required to do, that does not prevent us from taking steps against you at a later date.

19. Governing law and jurisdiction

These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales.

If you are a consumer resident elsewhere, you keep the benefit of any mandatory consumer protection rules of the country where you live, and you may bring proceedings in the courts of that country where the law allows.
