2. What this policy covers

It applies to our website and to any communication you have with us by email, contact form or social media. It does not apply to other websites we link to, which have their own privacy policies.

We sell to customers in the United Kingdom and internationally. Wherever you are, we handle your information in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. If you are in the European Economic Area, the EU GDPR also applies to you, and section 11 sets out the extra points that are relevant. If you are a California resident, see section 12.

We do not deliberately collect special category data such as health, religious or biometric information, and we ask that you do not send it to us.

4. How we use your information, and our legal basis for doing so

Under data protection law we need a lawful basis for everything we do with your information. The table below sets ours out.

What we use your information for Legal basis
Processing and delivering your order, taking payment and issuing refunds Performance of a contract with you

Answering questions and dealing with returns, complaints and faults Performance of a contract with you, and our legitimate interest in running a responsive business

Where we rely on legitimate interests, we have considered whether our interests are outweighed by your rights, and we have concluded that they are not. You can ask us for more detail on that assessment at any time.

5. Cookies and similar technologies

A cookie is a small text file placed on your device when you visit a website. Our store runs on Shopify, so most of the cookies used on this site are set by Shopify, either to make the store work or to measure how it is performing.

Strictly necessary cookies. These make the store function and cannot be switched off. They keep track of the contents of your basket, hold your session while you move between pages, secure your login and your checkout, and store your cookie preferences. Examples include cookies that hold your cart contents and cart identifier, session and checkout tokens, secure customer session identifiers and the record of your tracking consent choice.

Analytics and performance cookies. These help us understand how visitors use the site, which pages are popular and where people leave. Shopify sets its own first-party analytics identifiers for this purpose, and if we use Google Analytics, that will also set cookies. Shopify has been changing how storefront analytics identification works, so the exact cookie names on our site may differ from older published lists.

Marketing and advertising cookies. If we run advertising, platforms such as Google or Meta may set cookies through our store so that they can measure conversions and show you relevant adverts. These are set by those platforms, not by us, and are governed by their own policies.

Managing your choices. We use a cookie consent banner. Non-essential cookies are only set where you have agreed to them, and you can change your mind at any time using the cookie settings link on our site. You can also block or delete cookies through your browser settings, though the store may not work properly if you block the strictly necessary ones.

Because apps and integrations can add cookies to a store over time, the definitive list for our site is the one produced by the cookie scan behind our consent banner. If you would like a current list, email us at info@wetweatherkids.com.

6. Who we share your information with

We do not sell your personal information. We share it with the following types of organisation, only as far as they need it to do their job for us:

Shopify Inc., which hosts our online store and processes orders, payments and store analytics on our behalf
Payment providers, including Shopify Payments and any other method offered at checkout such as PayPal, Apple Pay, Google Pay or Klarna, which handle your payment details directly
Delivery companies and postal services, which receive the name, address and contact details needed to deliver your parcel
Email and marketing platforms, which send our order notifications and marketing emails
Analytics and advertising providers, where you have consented to the relevant cookies
Apps installed on our Shopify store, such as reviews, returns or customer service tools
Our professional advisers, including accountants, insurers and lawyers, where they need the information to advise us
Regulators, law enforcement and other authorities, where we are required to disclose information by law

If our business is sold or transferred, customer information may transfer with it. We would tell you before that happened and your information would remain subject to this policy.

7. Sending information outside the UK

Some of our suppliers, including Shopify, are based outside the United Kingdom, and some of our customers are too. That means your information may be transferred to and stored in countries outside the UK and the European Economic Area, including the United States and Canada.

Where that happens, we make sure one of the following applies:

The country has been formally recognised by the UK government as providing an adequate level of protection
The transfer is covered by the UK International Data Transfer Agreement, or by the EU Standard Contractual Clauses together with the UK Addendum
Another safeguard permitted by data protection law applies

You can ask us for details of the safeguards that apply to a particular transfer by emailing info@wetweatherkids.com.

8. How long we keep your information

Type of information How long we keep it
Order, invoice and payment records Seven years from the end of the financial year in which the order was placed, to meet HMRC requirements
Customer account details For as long as your account is open, and for a reasonable period afterwards in case you return
Customer service correspondence Up to three years from the last contact
Marketing contact details Until you unsubscribe or ask us to remove you, and then on a suppression list so that we do not contact you again by mistake
Cookie data For the lifetime of the individual cookie, which ranges from the end of your visit to around a year
Product safety and complaint records For as long as needed to meet our obligations under product safety law

When we no longer need information, we delete it or anonymise it so that it can no longer be linked to you.

9. Keeping your information secure

Our store runs on Shopify, which maintains PCI DSS compliance for payment processing and secures the site with encryption in transit. We restrict access to customer information to the people who need it, use strong authentication on our admin accounts and review the apps connected to our store.

No system can be completely secure. If a breach occurs that is likely to result in a risk to your rights and freedoms, we will notify the Information Commissioner's Office within 72 hours where required, and we will tell you directly where the law requires it.

10. Your rights

Under UK and EU data protection law you have the right to:

Be informed about how we use your information, which is what this policy is for
Access the personal information we hold about you
Rectification, meaning correction of anything inaccurate or incomplete
Erasure of your information in certain circumstances, sometimes called the right to be forgotten
Restrict processing while a question about your information is resolved
Data portability, meaning a copy of information you gave us in a machine readable format
Object to processing based on our legitimate interests, and to object to direct marketing at any time
Withdraw consent where we rely on it, without affecting anything done before you withdrew it
Not be subject to automated decision making that produces legal or similarly significant effects. We do not make decisions of that kind about you, although our payment providers may run automated fraud checks

To exercise any of these rights, email info@wetweatherkids.com. We will respond within one month. There is no charge unless a request is clearly unfounded or excessive. We may ask you to confirm your identity before we act, to make sure we are not disclosing your information to someone else.

You can unsubscribe from marketing emails at any time using the link at the bottom of any message, or by emailing us.

If you are unhappy with how we have handled your information, please tell us first so we can put it right. You also have the right to complain to the Information Commissioner's Office, the UK supervisory authority, at ico.org.uk or on 0303 123 1113.

11. Additional information for visitors in the European Economic Area

If you are in the EEA, the EU GDPR applies to your information as well as this policy. The rights in section 10 apply to you in the same way, and you have the right to complain to the supervisory authority in the country where you live or work.

12. Additional information for California residents

If you are a California resident, you have the right to know what personal information we collect and how we use and disclose it, to request a copy, to request deletion or correction, and to opt out of the sale or sharing of personal information for cross context behavioural advertising. We do not sell personal information for money. Where we use advertising cookies, that may count as sharing under California law, and you can opt out through our cookie settings link or by using a Global Privacy Control signal in your browser. We will not discriminate against you for exercising these rights. To make a request, email info@wetweatherkids.com.

13. Children

Our products are made for children, but our website is intended for adults. We do not knowingly collect personal information from anyone under 16, and orders must be placed by someone aged 18 or over. If you believe a child has given us their information, email info@wetweatherkids.com and we will delete it.

14. Other websites

Our website may link to other sites, including social media platforms and our suppliers. We are not responsible for their content or their privacy practices, and we would encourage you to read their policies before giving them your information.

15. Changes to this policy

We may update this policy from time to time, for example if we add a new supplier or change how the store works. The date at the top shows when it was last revised. If we make a significant change, we will make that clear on the website or, where appropriate, contact you directly.
